Present: Mayor Jerry Robinson. President of the council: Pat Joyce. Council members: Rickie Haney, Kenny Koenig, Jack Lucke, and Marty
VanFossen.
Employees: Lori Ulrich, City Treasurer. Eric Eagle, Water/wastewater superintendent. Traci Kuhn, City Clerk.
Citizens present: Byron VanFossen, Amy Corbin, and Robert Kuhn.
Mayor Robinson called the regular council meeting for the month of December to order at 7:02 p.m.
Mayor Robinson called for a motion to accept the minutes from the November 2, 2009 regular council meeting and November 9, 2009 special council
meeting. C.M. Marty VanFossen moved to accept the minutes as read. C.M. Rickie Haney seconded motion. Motion carried 5-0.
New Business – There was none.
Lori Ulrich – City Treasurer’s Report
City council reviewed the treasurers’ report for the month of November. C.M. Jack Lucke moved to accept the treasurers’ report. C.M. Marty VanFossen
seconded motion. Motion carried 5-0.
Fire Department
Mayor Robinson reported that he has purchased the necessary material to finish the fire siren at Microlite and Main. Radiant Electric will run the new
wire. Mayor Robinson reported that some of the materials purchased prior to meeting with Radiant should be returned for credit.
City council requested that Mayor Robinson visit with the fire department and request that if the chief or assistant are unable to make the meetings that
they have someone from the department be in attendance to represent the department.
Eric Eagle Report
Eric reported that the city was not transferred onto Public Wholesale #23 as planned today. He also advised that he had visited with KDHE concerning
combining the waters and we should not have to drain our tower when connecting. Eric reported that he did not think we would need to order more
chemical and may be able to return some.
Eric advised that he will be Christmas lights up soon. C.M. Marty VanFossen moved to accept Erics report. C.M. Jack Lucke seconded motion. Motion
carried 5-0.
Traci Kuhn – City Clerk Report
Traci reported that the computer generated water loss for November was 13.57%.
Traci advised that the council had a copy of the letter received from Rural District #10 advising that they will no longer be purchasing water from the
city upon connecting to Wholesale #23.

Mayor Robinson advised that the city clerk will be sending a letter to Rural #11 for confirmation from them as well.
C.M. Marty VanFossen moved that the city clerk contact the city attorney in reference to the types of debts that can be sent to Kansas setoff as the
setoff program had advised her to contact him. C.M. Rickie Haney seconded motion. Motion carried 5-0.
C.M. Jack Lucke moved to accept the city clerks report. C.M. Marty VanFossen seconded motion. Motion carried 5-0.
Public Wholesale #23
Mayor Robinson reported that he did not have a connection date at this point. Due to filter issues, they had voted to put $150,000. that was due to
Fredonia into an escrow account. Due to Fredonia not signing the deed, a special meeting was held and the amount to go into escrow was lowered to
$80,000.
Mayor Robinson Issues:
Mayor Robinson reported that the council had a copy of the building permit application. There was much discussion pertaining to the permit. The
purpose of the permit is to make sure that those building are not building on or over city easements and let the city know what is going up in town.
After much discussion C.M. Jack Lucke move to approve the building permit application and charge a fee of $ 20. per permit effective Dec. 8, 2009.
This fee will help cover the cost of an employee marking the city easements. C.M. Marty VanFossen seconded motion. Motion carried 5-0. When the
city clerk visits with the city attorney concerning Kansas setoff, she will have him review the application and find out if an ordinance will need to be
drawn up.
City council reviewed ordinance #226J concerning a water rate increase. C.M. Jack Lucke moved to pass ordinance #226J. C.M. Rickie Haney
seconded motion. Motion carried 5-0.
Mayor Robinson reported that the senior citizen board had approached him concerning the building inspections after the building has been rented.
Amy Corbin spoke to the council as a representative for the seniors. She gave the city clerk a list which they had written up of things that needed to be
inspected after the building is used. There was some discussion of requiring a deposit to be refunded if it was cleaned. The council decided to
continue with the rental as it currently is and use the checklist the seniors drew up when inspecting the building. In three months they will review how it
is working.
Mayor Robinson advised that the council each have a copy of a rough draft ATV ordinance from the League of Municipalities. Each will take it home
to review and make changes. They will go over it at the next regular meeting.
C.M. Marty VanFossen moved to have the annual city council and city employee Christmas dinner on Friday, December 18, 2009 at 6:30 p.m. at the
Stockyard in Fredonia. C.M. Jack Lucke seconded motion. Motion carried 5-0.
SANTA WILL BE VISITING THE BUFFALO COMMUNITY BUILDING ON TUESDAY, DECEMBER 15, 2009 AT 6:30 P.M.
Mayor Robinson advised that he would like to see the land behind city hall cleaned up. After much discussion, P.O.C. Pat Joyce moved to put a
notice on the door at city hall and take sealed bids on the slipper slide as it needs fiberglass repaired as well as new safety railings. Sealed bids

can be turned into the city hall and will be opened January 4, 2010 at the city council meeting. C.M. Marty VanFossen seconded motion. Motion
carried 5-0. C.M. Jack Lucke moved to have the city employee put a new roof on the outhouse and preserve it as it has historical background. C.M.
Kenny Koenig seconded motion. Carried 5-0.
There was discussion concerning the basketball goals that are being stored in the city barn. After some discussion C.M. Marty VanFossen moved to
spend what was necessary to have them fixed and contact Radiant Electric to have them put up in the spring. C.M. Rickie Haney seconded motion.
Motion carried 5-0.
Monthly Bills
Council reviewed the monthly bills for November. After reviewing the bills P.O.C. Pat Joyce moved to pay all the bills with the exception of one from
Napa Auto Parts and one from Save-A-Lot. Mayor Robinson is to find out what the bills are for before they can be paid. C.M. Marty VanFossen
seconded motion. Motion carried 5-0.
With no further business, C.M. Jack Lucke moved to adjourn the meeting at 8:25 p.m. P.O.C. Pat Joyce seconded motion. Motion carried 5-0.
